These Terms of Use ("Terms") govern your use of SmartRemote ("SmartRemote", "the App", "we", "us", or "our"). By downloading, accessing, or using the App, you agree to these Terms.

If you do not agree to these Terms, do not use the App.

This document is a product-specific draft and should be reviewed by legal counsel before publication.

1. The App

SmartRemote helps you discover supported devices on your local network and use remote-control, touchpad, keyboard, casting, favorite-channel, and related features.

Device compatibility depends on your TV, streaming device, network configuration, firmware version, enabled services, and third-party device settings. We do not guarantee that every device, app, channel, or command will be available or work at all times.

2. Eligibility

You must be legally able to enter into these Terms. If you use the App on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.

The App may request permissions such as local network access, tracking permission, notifications, and other permissions needed for app functionality.

You are responsible for ensuring that you have permission to access and control any device you connect to or operate through the App. Do not use the App to access or control devices without authorization.

SmartRemote may offer paid subscriptions or other in-app purchases through Apple In-App Purchase.

Subscription details, including title, duration, price, trial availability, renewal terms, and included features, are shown in the App before purchase and in the App Store purchase sheet.

By confirming a purchase, you authorize Apple to charge your Apple Account according to the price and terms displayed at purchase.

6. Auto-Renewable Subscriptions

If you purchase an auto-renewable subscription:

Apple handles billing, renewals, cancellations, and refunds according to Apple Media Services terms and App Store rules.

7. Refunds

Purchases made through Apple are handled by Apple. We cannot issue App Store refunds directly. You may request a refund through Apple where available.

8. Changes to Features and Pricing

We may change, suspend, or discontinue features, plans, subscription offerings, or support for certain devices. Subscription pricing and renewal changes are handled through Apple and will be presented according to App Store requirements.

9. Third-Party Devices and Services

The App may interact with TVs, streaming devices, apps, channels, and services provided by third parties. We are not responsible for third-party devices, services, firmware, availability, content, policies, or changes.

Use of third-party devices or services may be subject to additional terms from their providers.

10. Privacy

Our Privacy Policy explains how we collect, use, and protect information. By using the App, you also agree to our Privacy Policy.

11. Intellectual Property

The App, including software, design, text, graphics, logos, and other content, is owned by us or our licensors and is protected by intellectual property laws.

You receive a limited right to use the App for personal, non-commercial use according to these Terms and the applicable App Store license terms.

12. Disclaimer

The App is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

We do not guarantee uninterrupted operation, device compatibility, availability of third-party devices or services, or that the App will be error-free.

13. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, device functionality, or business opportunities arising from or related to your use of the App.

Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

14. Termination

We may suspend or terminate access to the App if you violate these Terms, misuse the App, or create risk for us, other users, or third parties.

You may stop using the App at any time. Deleting the App does not automatically cancel an active App Store subscription; you must cancel subscriptions through your Apple Account.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we may provide additional notice where required. Continued use of the App after changes become effective means you accept the updated Terms.
